Terms and Conditions
Welcome to Toss It Companies! These Terms and Conditions ("Terms") govern your use of our services (the "Services") from Toss It Dumpsters, LLC, Toss It Portacans, LLC and Toss It Waste, LLC (collectively, the "Company," "we," "us," or "our"). By booking a rental, submitting a quote request, or otherwise using our Services, you ("Customer," "you," or "your") agree to be bound by these Terms.
1. Services Provided
We provide temporary and permanent waste rental units and portable sanitation services for residential, commercial, and construction customers. Availability of Units (defined below), delivery windows, and service areas is subject to change without notice.
Temporary Waste Rental Units (each, a “Unit”):
- Roll-Off Dumpsters (Open Top Dumpsters)
- Concrete Washout Pans
- Portable Restrooms
- Handwash Stations
- Office Holding Tanks
- Other Rental Equipment not specified
2. Booking and Rental Agreement
- All rentals require an order confirmation, either online, by phone, or in writing, which forms a binding agreement between you and the Company.
- Rental rate(s), size of dumpster(s), service schedule(s), rental period(s), and delivery/pickup dates will be confirmed at the time of booking.
- We reserve the right to refuse service to any Customer in our sole discretion.
3. Rental Period
- A rental period begins on the date a Unit is delivered, unless otherwise agreed in writing.
- It is your responsibility to schedule the pickup of a Unit by the end of the rental period. Failure to schedule pickup by the end of the rental period may result in daily rental charges until such pickup is properly scheduled.
4. Location and Placement
- You are responsible for providing and identifying a safe, permissible, accessible, and level placement for each Unit at the specified location prior to delivery and pickup.
- You must ensure there is adequate clearance for delivery and pickup vehicles, including overhead clearance for power lines, tree branches, and other obstructions. If there is any question regarding the minimum height needed, you must call prior to delivery to confirm.
- We are not responsible for damage to driveways, walkways, lawns, septic systems, underground utilities, or other property resulting from delivery, placement, or pickup, unless caused by the Company's gross negligence.
- You are responsible for obtaining any and all required permits from applicable governmental entities. Fines or penalties resulting from failure to obtain permits are the Customer's responsibility, and any such fees received directly by the Company will be billed to you.
- If instructions are not given to our dispatch or driver, our driver will attempt to call the Customer. If unable to reach a Customer contact, our driver will select a location using their best efforts.
5. Prohibited Materials
The following materials are strictly prohibited from being placed in any of our Units:
- Hazardous or Toxic Waste (chemicals, solvents, pesticides, asbestos, etc.)
- Flammable or combustible materials, fuels, and propane tanks
- Batteries, motor oil, and other automotive fluids
- Tires of any size
- Medical or Biohazardous waste
- Liquids Paints, stains, and lacquers (unless fully dried/hardened, where locally permitted)
- Refrigerators, freezers, air conditioners, or other appliances containing refrigerants (Freon), unless certified as reclaimed.
- Railroad Ties – Telephone Poles other creosote-soaked logs
- Any other material prohibited under applicable local, state, or federal law.
The Customer is solely responsible for ensuring that only permitted materials are placed in the dumpster. We reserve the right to refuse pickup, charge additional fees, or bill you directly for third-party disposal costs, fines, or remediation resulting from prohibited materials.
6. Customer Responsibilities
As applicable, you agree to:
- Ensure there is no burning of waste in any of our Units.
- Ensure no third-party providers are used to remove, empty, or relocate a Unit without our prior approval.
- Ensure roll off dumpsters are not loaded above the fill line or top edge of the dumpster.
- If primarily concrete/dirt/dense materials are placed inside the dumpster the dumpster must not exceed 12 cubic yards of material.
- Prevent the use of our Units by unauthorized persons.
- No crushing of materials in dumpster by excavator, rollers, etc. Compaction must occur outside the unit to prevent damage to the unit.
- Ensure no unauthorized or prohibited materials are placed in any Unit.
- Promptly notify us of any damage, safety hazard, or issue involving a Unit immediately.
- Ensure the following items do not go into the dumpster:
- Aerosol Cans
- All Liquids
- Animals
- Anti-Freeze
- Appliances with Freon (Refrigerators, Freezers, Etc.)
- Asbestos
- Barrels
- Batteries
- Chemical Products
- Oils (Solvents, Gasoline, Diesel, Motor Oil, Etc.)
- Liquid Paint
- Dirt & Dense Concrete
- Hazardous Waste
- Fluorescent Tubes
- Herbicides & Pesticides
- Medical Waste
- Propane Tanks
- Petroleum contaminated materials
- Radioactive Material
- Railroad Ties & Telephone Poles
- Tires
7. Over-Weight and Other Fees
- Each roll off dumpster rental has an included weight allowance, as specified in the Customer's rental agreement, quote, or invoice. Weights exceeding the included amount will billed at a per-ton (or per-pound) rate after being weighed at the disposal facility.
- The legal tonnage limit for our trucks is 10 tons. Service requests for roll off dumpsters with weights in excess of that limit may be refused until the load is reduced and/or may incur additional surcharges.
- Damage to a Unit will be billed to Customer after being quoted for repair, and we reserve the right to include “down time” charges not to exceed the standard rental rate.
- Overfilled dumpsters (i.e., waste loaded above the fill line or top edge) may be refused for pickup until the load is reduced and/or may incur an overfilled fee.
8. Payment Terms
- Payment is due as specified on the invoice.
- Unless credit terms are approved, Customer must provide a credit or debit card to be ran on the due date.
- Additional charges (e.g., over-weight fees, daily rental fees, prohibited material fees, overfilled fees) may be billed separately or in combination with standard rental invoices.
- Late payments may be subject to interest charges, collections processes, and/or suspension of future service.
9. Cancellations and Rescheduling
- Cancellations must be made at least one business day prior to the scheduled delivery date to avoid a cancellation fee of $120. Cancellations made while delivery or pickup is en route may incur additional surcharges.
- Rescheduling requests are subject to availability.
- No refunds will be issued once a Unit has been delivered, except in our sole discretion.
10. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Services, including but not limited to property damage, loss of use, or personal injury, except to the extent caused by the Company's gross negligence or willful misconduct.
The Company's total liability for any claim arising from these Terms or the Services shall not exceed the total amount paid by the Customer for the rental giving rise to the claim.
11. Indemnification
The Customer agrees to indemnify, defend, and hold harmless the Company, its owners, employees, and agents from any claims, damages, losses, fines, or expenses (including reasonable attorney's fees) arising out of the Customer's use of one or more Units, violation of these Terms, or violation of any applicable law or regulation.
12. Property Damage and Safety
- The Customer assumes responsibility for any injury or damage resulting from unauthorized use, movement, or tampering with a Unit by the Customer, their employees, contractors, or invitees.
- Units remain the property of the Company at all times during the rental period.
13. Right to Refuse or Remove Service
We reserve the right to refuse delivery, delay pickup, or remove a Unit from a Customer's property at any time if:
- Prohibited materials are found or suspected,
- The placement location is deemed unsafe,
- Payment obligations are not met, or
- The Customer violates any provision of these Terms.
14. Changes to These Terms
We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our Services or website following any changes constitutes acceptance of the revised Terms. The "Effective Date" at the top of this page will reflect the most recent update.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Kerrville, Texas.
